Eligibility.
No purchase necessary. You must be eighteen (18) years of age or older and be a legal resident of the United States. This contest is void where prohibited.

How to Enter.
Contestant shall create a design (the "Design") which he or she will submit via: electronic mail (the "Entry") to festival8contest@phish.com during the contest. The contest begins August 27th at 5:00pm EST and ends September 11th at 12:00pm EST. The Entry will be deemed made by the "Contestant". Each Contestant may submit only one entry during the contest period.

Disclaimer.
Contestant assumes responsibility for a delayed, misdirected, lost, incomplete, or otherwise damaged Entry or for hardware, software, computer and other electronic and/or human difficulties or errors that may occur with an Entry or Prize. Phish reserves the right to disqualify any Entry it deems, in its sole discretion, to be obscene or otherwise inappropriate. Phish reserves the right in its sole discretion to cancel or suspend the contest or any portion thereof for any reason. Phish shall have the right but not the obligation to create t-shirts and/or other merchandise embodying any Design(s) entered into the contest and the right but not the obligation to display any Design(s) entered into the contest.

Prize Details.
The winning Design will be selected by Phish on or around September 14th, 2009. A non-refundable, non-transferable Prize consisting of two (2) tickets to "FESTIVAL 8" will be awarded to the winning Contestant (the "Winner"). The Winner will also be provided with five (5) of any items manufactured using the Design. The Winner will be notified of the Prize within 48 hours of selection of the winning Design by phone and/or electronic mail at the address and numbers provided in the Entry. Phish is not responsible for any changes in email addresses or phone numbers. It is the Contestant's duty to provide an accurate address and contact information in the Entry.

Warranty.
By entering the Contest, you warrant and represent that all information provided by you as part of the Entry is true, accurate and complete, that you are the sole creator and legal owner of the Entry and all parts of the Entry and that the Entry consists entirely of your original Design.

Ownership.
By submitting your Entry you hereby grant to Phish any and all ownership you have in the Entry and/or Design. The Entry and/or Design shall be considered work made for hire authored by Phish under the U.S. Copyright laws. To the extent that the Entry and/or Design is determined not to be work made for hire, you hereby assign and transfer to Phish the entire right, title, and interest (including but not limited to all perpetual rights under copyright throughout the universe) in and to the Entry and/or Design, including the exclusive, unlimited and perpetual universe-wide rights to use and possess the Design and/or Entry (including all portions, all materials produced in connection with the Design and/or Entry, and all images, words, logos, designs and characters created for and/or contained therein), for any purposes, and in any medium, now known or devised in the future, including but not limited to the exclusive right to reproduce, distribute, publish, and use and license others to use the Design and/or Entry or derivative works made from the Design and/or Entry in connection with merchandise of any sort. You agree that the Design and/or Entry owned by Phish by virtue of this Contest includes all mechanical and other physical materials as well as any electronic or digital representations and reproductions relating to the Design and/or Entry, from the inception of its creation.

Use and Display.
You may not use any portion of the Entry and/or Design for online or other public display or transmission or any other commercial or non-commercial usage. You agree that you will not offer, advertise or provide value added services to the Design and/or Entry or merchandise manufactured from the Design and/or Entry, including but not limited to marking, re-marking, autographing or re-autographing, numbering, re-numbering, cutting, pasting, compiling or modifying in any other way. You agree you will not make or offer to make any alteration to the Design and/or Entry or merchandise created from it for any financial proceeds of any kind. Any contact you have with any manifestation of the Design and/or Entry or associated merchandise after it is created shall be completely non-commercial and free of any charge or fee whatsoever.

Winner.
You agree if you are chosen as Winner, you will sign a hard copy of this acknowledgment before you are eligible to collect the Prize. You agree that should you be selected as Winner, Phish may use your name, likeness and any materials submitted with your Entry including the Design for promotional and publicity purposes without limitation and without further compensation.
